Terms and Conditions
Last updated: 24 October 2026 (version 2026-10-24)
These Terms have two parts. The main text (Sections 1-22) applies to all Users, wherever they are located. The annexes at the end of this document supplement the main text with rules that apply to Users from a particular country or region. Where an annex differs from the main text, the annex prevails for the User it covers.
1. Who we are and what these Terms cover
The IzeshMenu platform (izeshmenu.com, the "Platform") is provided by NENAD BUGARSKI PR AGENCIJA ZA KREATIVNE MEDIJE I PROGRAMIRANJE PIXELSPIRE SRBOBRAN, Vrbaska br. 4, 21480 Srbobran, Republic of Serbia, company ID 62838167, tax ID 107575085 (the "Provider" or "we"). Contact: [email protected].
These Terms and Conditions (the "Terms") form an agreement between the Provider and the person who opens an account and uses the Platform (the "User"). By ticking the acceptance box when registering, or by signing in with a Google account or a link sent by email, the User confirms that they have read, understood and accepted the Terms. If you do not agree with the Terms, do not use the Platform. The Privacy Policy forms part of these Terms.
2. The Platform is for business users
- The Platform is intended exclusively for hospitality venues, sole traders and companies, for the purposes of their business. It is not intended for consumers, that is, natural persons acting outside their trade or business.
- The person opening an account confirms that they are of legal age and authorised to accept these Terms on behalf of the venue or company, or in the course of their own business (e.g. as an editor providing services to venues). If not, the person who opened the account is personally liable for the obligations under these Terms.
- Guests who open a public menu via a QR code or link do not enter into an agreement with the Provider; Section 10 applies to them.
3. The service
The Platform lets venues create and publish digital menus: categories and items, AI menu recognition from photos, AI descriptions and automatic translations, design themes, banners and galleries, QR codes, a public menu address and menu view statistics. Available features depend on the selected plan. An account without a subscription is intended for getting to know the Platform and has limited features.
The Platform is a technical tool. The Provider does not write, check or approve menu content and is not the publisher of that content.
4. Account and security
- The User must provide accurate registration and billing details and keep them up to date.
- The User keeps their login details confidential and is responsible for all actions taken through their account, including actions of people they have given access to (e.g. staff, contractors or editors).
- The User must notify us without delay of any unauthorised use of the account.
- Opening multiple accounts to get around the limits of accounts without a subscription is prohibited.
Venue editors. The User who created a venue, or to whom a venue has been transferred, is the owner of that venue. The owner may give another User access to edit the venue (an "editor"), on the following terms:
- The owner adds an editor by entering the email address of the editor's account. A User who turns on the editor role in their account settings may also request access to a venue; access is granted only once the owner approves it.
- An editor may edit the venue's settings and public address, menus (including deleting them), items, translations, gallery, banners and allergens, and may use AI import. An editor may not delete the venue, manage the subscription or payments, add or remove editors, or transfer the venue.
- The owner is responsible for the venue's content and for the editor's actions on the venue as for their own. The editor must comply with these Terms and is responsible for their own actions; for breaches of these Terms we may also take the measures in Section 9 against the editor's account.
- Content an editor enters becomes the venue's content and stays with the venue after the editor's access ends. The editor warrants that they hold the rights described in Section 7 to the materials they upload and grants the owner the right to use them on the Platform; any other rights to those materials are a matter between the owner and the editor.
- No subscription is needed for the editor role. The features an editor uses on a venue depend on that venue's plan, and AI imports started by an editor count towards the limits of the venue and the owner's account.
- The Provider is not a party to the relationship between the owner and the editor, does not vet editors, does not guarantee their work and charges no commission. The owner and the editor agree on and settle fees and other terms of their cooperation themselves; an editor is not an employee or agent of the Provider.
- The owner may remove an editor, and an editor may leave a venue, at any time; access ends immediately. Access also ends when the venue or the owner's account is deleted.
- On request, the Provider may transfer a venue to another User's account (e.g. when an editor has set up a venue for a client or the venue changes hands), with the consent of the current and the new owner or other proof of entitlement to the venue. We do not transfer a venue that has a subscription attached until the subscription has ended. The new owner takes over the venue with its content and responsibility for it; the previous owner loses access unless the new owner adds them as an editor.
5. Menu content - the User's responsibility
The User is solely and fully responsible for all content they enter, import or publish through the Platform, in particular for:
- the accuracy and currency of prices, including the obligation to display prices under consumer protection and trade regulations;
- information about food and drinks, including ingredients, allergens, nutrition values, origin and quantities, and any other information required by food safety and consumer information regulations;
- warnings and restrictions (e.g. alcoholic drinks, age restrictions, special diets);
- availability of items, opening hours and other venue details;
- translations, descriptions and texts, including those suggested or generated by AI features;
- photos, logos, names and other materials, as well as any personal data the User includes in them.
The Provider does not check content and is not liable to guests, authorities or third parties for its accuracy, completeness or lawfulness. The User must give guests another way to obtain allergen and ingredient information (e.g. a printed menu or information from staff), in particular in case the digital menu is temporarily unavailable.
6. AI features
- AI menu recognition from photos, AI descriptions and automatic translations rely on external AI services and may contain errors, omissions or incorrect translations, including wrong prices, names, ingredients and allergens.
- AI output is a suggestion. The User must review and correct it before publishing. By publishing a menu the User confirms that they have checked the content and are responsible for it.
- Automatic translations are refreshed after the menu is changed; the User must also check the translations in the languages they publish.
- The User must not submit photos containing personal data of third parties or confidential information for AI processing.
- The number of AI imports on an account without a subscription is limited; current limits are shown in the app.
7. Content rights and licence
- The User keeps all rights to the content they enter.
- The User warrants that they hold all necessary rights (copyright, trademark and others) to the photos, logos and texts they upload and that their use does not infringe third-party rights.
- The User grants the Provider a non-exclusive, royalty-free licence, limited to the duration of use of the Platform, to store, process (e.g. resize images, translate, adapt to a theme) and publicly display the content as needed to provide the service.
- The software, themes, design and the IzeshMenu mark belong to the Provider. The User receives a right of use for the duration of the account, without the right to copy, resell, decompile or create derivative works.
8. Prohibited use
- publishing unlawful, misleading, offensive or discriminatory content, or offering goods and services whose sale is prohibited;
- infringing intellectual property or privacy rights of third parties;
- attempting to bypass security, accessing other users' accounts or data without authorisation, disrupting the Platform or automated mass downloading of content;
- using the Platform for spam or fraud.
9. Reporting illegal content and moderation
- Anyone may report content on the Platform that they believe is unlawful or breaches these Terms by emailing [email protected]. The report should include: the address (URL) of the content, an explanation of why the content is unlawful, the name and email of the person reporting (except for reports concerning child sexual abuse), and a statement that the report is accurate and made in good faith. Copyright infringement must be reported by the rights holder or their representative.
- We review reports manually, without automated decision-making, within a reasonable time, and inform the person reporting of our decision.
- We do not review content in advance. Where we find that content is unlawful or breaches the Terms, we may remove it or disable access to it, restrict features, or suspend or terminate the account. We choose measures in proportion to the seriousness and repetition of the breach; we terminate the account of a User who repeatedly infringes the rights of others or publishes unlawful content.
- We inform the User of the measure and the reasons for it (which content, on the basis of which law or provision of the Terms, and how the decision was made), unless this is prohibited by law or by an order of a competent authority.
- The User may challenge the decision within 6 months by replying to our notice or by emailing [email protected]. The complaint is reviewed by a person who did not make the original decision; if the complaint is justified, we lift the measure.
- If content makes us aware of a criminal offence that threatens the life or safety of persons, we will notify the competent authorities.
10. Guests and public menus
- A public menu shows content entered by the venue. Prices, ingredients, allergens and other information are provided by the venue, which is responsible for them.
- Guests with allergies, intolerances or special diets should confirm the information with the venue's staff before ordering.
- The Provider is not a party to the relationship between the guest and the venue (orders, payment, service).
- The Provider counts public menu views without cookies, as described in the Privacy Policy. The User receives only aggregate statistics (e.g. number of views, languages, most viewed items). The statistics are approximate (affected, for example, by content blockers and caching) and are for guidance only; the User must not use them to try to identify guests.
11. Plans, prices and payment
- Paid plans and prices are shown in the app at the time of purchase. A plan covers one venue.
- Card payments are handled by Paddle.com Market Limited as the authorised reseller (Merchant of Record). Paddle's buyer terms also apply to such purchases; Paddle issues the invoice and handles tax.
- Users in Serbia may pay against a pro-forma invoice. Paid features are activated only once the payment is recorded; the pro-forma invoice is valid within the payment deadline stated on it. An invoice is issued after payment.
- Subscriptions paid by card renew automatically at the end of each period (monthly or annually, as shown at purchase), at the price applicable at that time, until the User cancels.
- Subscriptions paid against a pro-forma invoice last for the paid period and do not renew automatically.
- Price changes apply from the next period and are announced at least 30 days in advance. A User who does not agree with the new price may cancel the subscription before renewal.
- When a subscription expires or is cancelled, the account becomes an account without a subscription: content is kept, but paid plan features are no longer available.
12. Cancellation and refunds
- The User may cancel the subscription at any time in the app, in the Subscription section. Cancelling stops automatic renewal, and access to paid features remains until the end of the paid period.
- Annual and seasonal subscriptions: within 14 days of purchase or of an annual renewal, the User may request a full refund for that period without giving a reason. Requests are made in the app (Subscription section), by email to [email protected] or, for card payments, via paddle.net. Once the request is approved, the subscription ends immediately. Details are set out in the Refund Policy.
- Monthly subscriptions: within 14 days of purchase, the User may request a refund of the full first monthly payment in the same way. Later monthly payments are not refunded; cancelling before the renewal date prevents the next charge.
- We make refunds within 14 days of approving the request, using the same payment method (for cards via Paddle, and for payments against a pro-forma invoice to the account from which the payment was made).
- Outside the cases set out in this section, amounts paid are not refunded, unless expressly required by law or by Paddle's buyer terms, or unless the service was unavailable for an extended time due to our fault.
13. Processing of data on behalf of the User
If the User enters personal data into the content (e.g. names or photos of staff or guests), the User is the controller and the Provider processes that data as a processor, solely to provide the service and on the User's instructions arising from the use of the Platform. In that case the Provider:
- processes the data only to provide the service and does not use it for any other purpose;
- ensures that persons with access to the data are bound by confidentiality;
- applies the safeguards described in the Privacy Policy;
- engages the sub-processors listed in the Privacy Policy and informs the User of changes to them by publishing the updated Policy; the User may object to the change and close the account;
- assists the User in responding to requests from data subjects and notifies the User without undue delay of any personal data breach affecting the User's content;
- deletes the data after the account ends, within the periods set out in the Privacy Policy;
- provides, on request, the information needed to demonstrate compliance with these obligations.
14. Data export and switching to another service
- The User may at any time request an export of their menu content (categories, items, prices, descriptions, translations, allergens and photo addresses) in a structured, machine-readable format (JSON or CSV), free of charge. We deliver the export within 30 days of the request.
- A User switching to another service may terminate the agreement with a notice period of no more than 2 months; after that, the User has at least 30 days to retrieve their data before we delete it. We charge no fee for switching.
15. Availability
- The Platform is provided "as is" and "as available". We aim for continuous operation but do not guarantee uninterrupted, error-free service or any particular level of availability.
- Operation may be interrupted for maintenance, upgrades or circumstances beyond our control, including failures of external services (hosting, storage, payments, email, AI), internet outages, attacks and force majeure.
- We may change, improve or discontinue features of the Platform. We will notify the User at least 30 days in advance before discontinuing a material paid feature.
- The User is responsible for keeping their own copy of important data (e.g. price lists).
16. Limitation of liability
- To the extent permitted by applicable law, the Provider is not liable for indirect damage, lost profit, loss of turnover, reputation or data, or for damage caused by content entered by the User, by AI processing errors the User did not correct, by temporary unavailability of the Platform or by the operation of external services.
- The Provider's total liability to the User on any grounds is limited to the amount the User paid the Provider for the service in the 12 months before the event giving rise to the damage.
- The limitations in this section do not apply to damage caused by the Provider intentionally or through gross negligence, or in other cases where the law does not allow liability to be excluded or limited.
17. Indemnity
The User shall indemnify and hold the Provider harmless from damage, costs and reasonable legal fees arising from claims by guests, authorities or third parties that result from:
- content the User entered or published, including incorrect prices and allergen or ingredient information;
- infringement of third-party rights (e.g. copyright in photos or privacy rights);
- breach of these Terms or of the law by the User or by people the User has given access to the account or venue, including editors.
18. Term and termination
- The agreement lasts as long as the User has an account. The User may delete the account at any time in the account settings when there is no active subscription, or request deletion at [email protected].
- The Provider may suspend the account or terminate the agreement with immediate effect for serious or repeated breach of these Terms, non-payment, a request by a competent authority or abuse, giving reasons as described in Section 9.
- The Provider may also terminate the agreement without cause by giving at least 30 days' notice; in that case we refund the pro rata portion of any prepaid subscription for the unused period.
- When an account ends, its public menu and QR codes stop working. Data is deleted within the periods stated in the Privacy Policy, except data we are legally required to keep (e.g. invoices).
19. Changes to these Terms
We may change these Terms. We will notify the Users affected by material changes by email or by a notice in the app at least 15 days before the changes take effect. Continued use after that date means acceptance of the changes; a User who does not agree may close the account before the changes take effect. Changes required by law or made solely for the User's benefit may take effect immediately.
20. Governing law and disputes
- These Terms are governed by the law of the Republic of Serbia, unless the annex for the User's country provides otherwise or the mandatory law of the User's country requires otherwise.
- The parties will first try to resolve any dispute amicably. Failing that, the court with subject-matter jurisdiction in Novi Sad, Republic of Serbia, has jurisdiction.
21. Final provisions
- If any provision is found to be void, the remaining provisions stay in force, and the void provision is replaced by a valid provision closest to its purpose.
- These Terms exist in several languages; in case of any discrepancy, the Serbian version prevails.
- We send notices to the User at the account's email address; the User can write to us at [email protected].
- The Provider may transfer the agreement to a legal successor of the business, with notice to the User. The User may not transfer the account without our consent.
22. Annexes
The annexes for specific countries and regions are set out below. Annexes for new countries are added over time; adding a new annex does not change the main text or the rights under existing annexes.
Annex A - European Union and European Economic Area
Effective from: 15 October 2026. Applies to Users established or resident in the European Union, Iceland, Liechtenstein or Norway, and to content reports received from those countries.
- Point of contact for Member State authorities, the European Commission and the European Board for Digital Services, and for recipients of the service (Articles 11 and 12 of Regulation (EU) 2022/2065, the "Digital Services Act"): [email protected]. We communicate in Serbian and English.
- Notices of illegal content, statements of reasons and challenges to decisions are handled under Section 9, in accordance with Articles 16 and 17 of the Digital Services Act. A notice containing the elements listed in Section 9 is considered sufficiently substantiated.
- Switching to another data processing service and data export are governed by Section 14, in accordance with Regulation (EU) 2023/2854 (the "Data Act"). The periods in Section 14 cannot be shortened by contract to the User's detriment.
- Before suspending or restricting an account, we state the reasons for the measure (Section 9), and we terminate the agreement without cause only with at least 30 days' notice (Section 18).
- The choice of Serbian law does not exclude the mandatory rules of the User's Member State that cannot be excluded by contract.
Annex B - United States of America
Effective from: 15 October 2026. Applies to Users established or resident in the United States.
- DISCLAIMER OF WARRANTIES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
- LIMITATION OF LIABILITY: THE PROVIDER IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND ITS TOTAL LIABILITY IS LIMITED AS SET OUT IN SECTION 16.
- Class actions: disputes are conducted solely on an individual basis; the User waives the right to participate in any class or collective action and the right to a jury trial, to the extent permitted by law.
- Copyright infringement (Digital Millennium Copyright Act, 17 U.S.C. § 512): send notices to [email protected] including: the signature of the rights holder or their agent, a description of the work, the address (URL) of the content, contact details, a statement of good-faith belief that the use is not authorised, and a statement under penalty of perjury that the information is accurate and that the complainant is authorised to act. A User whose content has been removed may submit a counter-notice containing the elements set out in § 512(g). We terminate the accounts of Users who repeatedly infringe copyright.
- Automatic renewal: the subscription renews as described in Section 11 until you cancel it in the app (Subscription section), which you can do at any time and in the same way the subscription was purchased (online).
- Sales tax on card payments is calculated and paid by Paddle as the seller.
- The User represents that they are not on any US sanctions list (e.g. OFAC) and will not use the Platform in breach of US sanctions and export control laws.
Annex C - Republic of Serbia
Effective from: 23 October 2026. Applies to Users established or resident in the Republic of Serbia.
- Information about the information society service provider (Law on Electronic Commerce): NENAD BUGARSKI PR AGENCIJA ZA KREATIVNE MEDIJE I PROGRAMIRANJE PIXELSPIRE SRBOBRAN, a sole trader registered in the Register of Business Entities kept by the Serbian Business Registers Agency, registered office at Vrbaska br. 4, 21480 Srbobran, company ID 62838167, tax ID 107575085, email [email protected].
- The Platform is intended exclusively for legal entities and sole traders for business purposes, so consumer protection laws do not apply to the agreement. The refund right in Section 12 is granted by contract, independently of those laws.
- An editor who is neither a sole trader nor a legal entity (e.g. an employee of a hospitality business) uses the Platform in the name and on behalf of the business whose venue they edit. An editor who independently provides paid services to venues is responsible for complying with the rules that apply to that activity, including registration and tax obligations; the Provider takes no part in agreeing or collecting payment for those services.
- Payments against a pro-forma invoice are made in Serbian dinars, by transfer to the current account stated on the pro-forma invoice or by scanning the IPS QR code. An invoice is issued after the payment has been recorded, in the form and manner prescribed by tax regulations.
- Disputes fall under the jurisdiction of the court with subject-matter jurisdiction in Novi Sad.
